Terms and Conditions – Monivea Road Limited

1. Monivea Road Limited (“Monivea Road”) 11 Merus Court, Leicester, United Kingdom, LE19 1RJ, company number 15703107 operates a website (“Website”) and provides a pharmaceutical dispensing service. (www.monivearoad.co.uk)

2. We are required to display logos on every page indicating that we are registered with the GPhC. Monivea Road’s GPhC premises registration is 15703107. Monivea Road’s Superintendent Pharmacist is Shaylen Patel, Reg No.: 2221628. We regularly ensure that all pharmacists who provide any service for Monivea Road Limited are registered with the General Pharmaceutical Council and have the correct annotations to their registration for the service they provide.

3. In this agreement, where we refer to “we” or “us”, we are referring to Monivea Road, its related companies, and its officers, employees, directors, agents and others engaged by it to perform work on its behalf. ‘You’ and ‘Your’ refer to yourself as the patient and customer.

4. By using our website, or any services provided by us, you agree that you are consenting to the below terms and conditions (“Terms and Conditions”), and to the Privacy Policy that appears on the Website at www.monivearoad.co.uk/patient-privacy-policy/.

5. All materials and information on this Website, including without limitation any logo, design, text, graphic and the arrangement (“Content”) are our intellectual property (or, in some cases, the intellectual property of a third party).

 

Service

6. We are an online pharmacy registered with the GPhC to sell medicines and services through our website www.monivearoadpharmacy.co.uk. We offer a range of private services that may be accessed through our website.

7. Other private services- medications are dispensed from our registered pharmacy. A specially trained prescribing pharmacist will review your online consultation to confirm the requested medication is appropriate for your needs, provided you have checked the consent box to receive treatment. If suitable, they will issue the prescription, and the medication will then be dispensed and delivered to you.

8. The medication will be delivered directly to you by the Royal Mail Health courier service. The delivery of medication necessitates a signature upon receipt, affirming the user’s direct acknowledgement and receipt of the medicinal products.

9. When ordering a generic treatment, please note that we work with various pharmaceutical wholesalers who supply different generic options. Therefore, we cannot guarantee which specific generic product will be supplied. If you have a preference for a particular manufacturer, please email hello@monivearoad.co.uk with your order number and specify your preferred generic. While we will make an effort to supply your preferred manufacturer, we cannot guarantee it. For all branded item orders, the specific brand purchased will be supplied.

10. We aim to provide medicinal products with a long expiry, typically 12 months or more. However, all pharmacies are required to ensure a minimum of 6 months’ expiry. If we can only source your medication with fewer than six months remaining until its expiration date, we will contact you prior to dispatching your order.

11. We highly recommend that you give us consent to inform your GP about any treatments you have initiated with us. This is for your own benefit, as once you start a treatment, your GP can ensure any medicines they may prescribe after you have started a treatment with us will not interfere or interact with each other. If you ask us to inform your GP, please ensure that you provide us with the correct GP information (including GP name, Surgery name and email); otherwise, we will not be able to contact them.

 

Monivea Road’s Obligations

12. Monivea Road is liable for ensuring that these prescriptions are dispensed correctly and in accordance with General Pharmaceutical Council standards and guidelines and these Terms and Conditions. Monivea Road is responsible for providing the service in accordance with these Terms and Conditions.

13. Monivea Road accepts liability for death or personal injury caused by its negligence and does not seek to exclude liability for fraudulent misrepresentation. You have certain rights under the law. These include that Monivea Road will provide the service with reasonable skill and care and within a reasonable time and in accordance with the descriptions provided and that the pharmacy will dispense the agreed prescription. You have certain legal remedies if Monivea Road breaches any of these rights. Nothing in these Terms and Conditions is intended to affect these legal rights or other rights to which you may also be entitled. For more information on your legal rights, contact your local Citizens Advice Service.

14. Monivea Road is not responsible for any failures or delays caused by you, the prescribing doctor, a Partner or parcel delivery service or for the failures or delays of each other.

15. Monivea Road is not responsible for losses not caused by its breach, indirect losses or a failure to provide the service due to any cause beyond its reasonable control which prevents it from fulfilling its obligations, including but not limited to fire, storm, riot, civil disturbance, war, nuclear accident, terrorist activity and acts of God.

16. If Monivea Road does breach these terms, it shall only be liable for losses which are a reasonably foreseeable consequence of such a breach. Losses are foreseeable where they could be contemplated by you and Monivea Road as relevant at the time of entering these Terms.

17. Subject to any relevant laws which may provide that certain matters cannot be contracted out of, we expressly disclaim all liability to you or any other persons for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) arising out of or referable to the Content or this Website (or material accessed via this Website), or to access of the Website by you.

 

Your Obligations

18. You agree to indemnify us against any claim made, or loss incurred, by any third party arising out of or relating to your conduct (including transmitting any defamatory, derogatory or offensive statements or material to any person), your use of the Website, your breach of these Terms and Conditions, or your breach of any rights of third parties.

19. You must not copy, distribute, republish, download, display, post or transmit the Content in any form or by any means, including but not limited to electronic, mechanical or otherwise, without our prior written permission or, where it is not our intellectual property, the written permission of the owner of that intellectual property.

20. You must not do anything to alter, modify or add to the Content, except where it is reasonable and appropriate for you to do so.

21. We may provide links on this Website to the websites of third parties. However, you acknowledge and agree that we have no control over and do not monitor these third-party websites. We make no representations regarding the accuracy, completeness or suitability of the third-party website, its products or services and do not accept any liability for these websites.

22. The Privacy Policy that appears on this Website (https://monivearoad.co.uk/) explains how personal information will be treated as you access and interact with this Website.

23. You are responsible for all of your activity in connection with accessing the Website. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your access to the Website and our services.

24. In accessing this Website, you must not engage in any unlawful or dishonest conduct, including attempting to disrupt or interfere with the Website, or any services, system resources, accounts, servers or networks connected to or accessible through this Website or linked websites.

25. If we issue you with a password that permits you to access certain parts of this Website, you are solely responsible for any use of the Website through such access, whether authorised or not.

26. You may choose to share your username and password with another person for the sole purpose of assisting you to lawfully order prescribed medicines from us (proxy access). However, liability for any misuse of your username or password by that person, or by any other person, remains with you.

27. You must immediately report to us if you learn that your account or password is compromised, such that we may take appropriate action to limit the dispensing of medicines to unauthorised third parties.

28. You must comply with all applicable laws and regulations that relate to your use of or activities on this Website.

29. You agree that you will:

29.1. When providing information to us, provide accurate and truthful information at all times;

29.2. Not purport to be a third party and not access the website using another person’s credentials, except as authorised in these Terms and Conditions; and

29.3. Not engage in any unlawful acts with respect to Monivea Road, including (but not limited to) obtaining and presenting unlawful prescriptions, or arranging for third parties to obtain prescriptions where you intend to use the medicines dispensed on those prescriptions.

29.4. You acknowledge that a breach of these Terms and Conditions may result in Monivea Road ceasing to provide services to you.

 

Customer ID verification

As a registered pharmacy, we are obliged to check our customers/patients’ identification. We use Yoti, an identity verification company, to verify your identity to ensure we are sending the medication to the correct person. A secure link for ID verification will be emailed to you after the purchase of a Prescription Only Medication (POM). Our ID verification process is a one-time requirement, applicable to any service for which a prescription is needed. Should we be unable to verify your identity, the cost of your treatment will be refunded. However, if false identification was used to try and circumvent our verification process, a deduction of up to £5 may be taken from your refund to cover the additional expense of enhanced ID checks.

 

How payment is made

30. We accept Visa, Mastercard, and American Express credit/debit cards. Payments can be made directly on our website using Square payments.

31. Voucher codes are applied to the value of the order. The voucher code must be entered in the appropriate box for the discount to be applied. Only one voucher code can be applied to any order.

 

Delivery

32. Orders are typically dispatched within 1 to 2 working days via your chosen postage method. While most items are delivered the next working day, this is not a guaranteed service and delivery may take up to 3 working days from dispatch. Please ensure someone is available to accept the delivery.

33. Your registered address is our preferred delivery location for your medicines. If you require an alternative posting address, please specify this in an email to us. Note that a home address is mandatory for us to complete the necessary ID check.

 

Responsibility

34. We are committed to the safe prescribing, dispensing, and delivery of your medications. We urge all patients/customers to be completely honest when answering questions about the treatment they require.

Please note:

● We cannot access your NHS medical records, as the NHS does not share data with private healthcare providers.

● We rely on the honesty and accuracy of the information you provide in clinical questionnaires.

 We will not be held liable for clinical negligence if you withhold or provide false information about your health to our clinicians.

 

 

How to cancel an order

35. You can always choose to stop using the service at any time. You can cancel an order placed through the service at any point until the medication is dispensed and you will receive a full refund with the same method of payment within 3-5 working days. You can make such cancellation by contacting us via the website. Alternatively, you can email us at hello@monivearoad.co.uk.

36. Once your prescriptions have been dispensed, you will be unable to cancel the order, return the medication or receive a refund. Any unwanted medicines must be disposed of by returning the medication to a pharmacy or to any authorised location (such as a registered pharmacy).

37. If you receive medication that is incorrect, dispatched in error or damaged, you should contact us via the website or alternatively at hello@monivearoad.co.uk to discuss a replacement or refund.

38. If our prescriber is unable to issue the prescription for any reason, a full refund will be processed within 3-5 working days of the order being received.

 

How to make a complaint

39. The best way to contact us to make a complaint is through the website or by emailing hello@monivearoad.co.uk. We aim to acknowledge complaints within three working days.

 

Third-Party Links and Liability

40. Our Website may include links to external sites that are not controlled by Monivea Road Ltd Trading as Monivea Road Pharmacy, unless explicitly stated otherwise.

41. We explicitly disclaim all responsibility for the content on these external Websites and assume no liability for any loss or damage, of any kind, that may arise from their use.

 

Governing law

42. These Terms and Conditions are governed by and construed in accordance with the laws of England & Wales, and you agree that the appropriate jurisdiction for any litigation or dispute is in England & Wales.

43. If any parts of these Terms and Conditions are deemed void or unenforceable, then that provision may be severed from these Terms and Conditions and all other provisions continue to apply.
